Za ak\u00e9ko\u013evek \u010fal\u0161ie k\u00f3pie, o ktor\u00e9 dotknut\u00e1 osoba po\u017eiada, m\u00f4\u017ee prev\u00e1dzkovate\u013e \u00fa\u010dtova\u0165 primeran\u00fd poplatok zodpovedaj\u00faci administrat\u00edvnym n\u00e1kladom. Ak dotknut\u00e1 osoba podala \u017eiados\u0165 elektronick\u00fdmi prostriedkami, inform\u00e1cie sa poskytn\u00fa v be\u017ene pou\u017e\u00edvanej elektronickej podobe, pokia\u013e dotknut\u00e1 osoba nepo\u017eiadala o in\u00fd sp\u00f4sob. Pr\u00e1vo z\u00edska\u0165 k\u00f3piu nesmie ma\u0165 nepriazniv\u00e9 d\u00f4sledky na pr\u00e1va a slobody in\u00fdch.<\/p>\n\n\n\n<p><strong>Pr\u00e1vo na opravu osobn\u00fdch \u00fadajov pod\u013ea \u010dl\u00e1nku 16:<br><\/strong>Dotknut\u00e1 osoba m\u00e1 pr\u00e1vo na to, aby prev\u00e1dzkovate\u013e bez zbyto\u010dn\u00e9ho odkladu opravil nespr\u00e1vne osobn\u00e9 \u00fadaje, ktor\u00e9 sa jej t\u00fdkaj\u00fa. So zrete\u013eom na \u00fa\u010dely sprac\u00favania m\u00e1 dotknut\u00e1 osoba pr\u00e1vo na doplnenie ne\u00fapln\u00fdch osobn\u00fdch \u00fadajov, a to aj prostredn\u00edctvom poskytnutia doplnkov\u00e9ho vyhl\u00e1senia.<\/p>\n\n\n\n<p><strong>Pr\u00e1vo na vymazanie (pr\u00e1vo \u201cna zabudnutie\u201d) pod\u013ea \u010dl\u00e1nku 17:<br><\/strong>Dotknut\u00e1 osoba m\u00e1 tie\u017e pr\u00e1vo dosiahnu\u0165 u prev\u00e1dzkovate\u013ea bez zbyto\u010dn\u00e9ho odkladu vymazanie osobn\u00fdch \u00fadajov, ktor\u00e9 sa jej t\u00fdkaj\u00fa, a prev\u00e1dzkovate\u013e je povinn\u00fd bez zbyto\u010dn\u00e9ho odkladu vymaza\u0165 osobn\u00e9 \u00fadaje, ak je splnen\u00fd niektor\u00fd z t\u00fdchto d\u00f4vodov:<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"has-body-font-size wp-block-list\">\n<li class=\"has-body-font-size\">osobn\u00e9 \u00fadaje u\u017e nie s\u00fa potrebn\u00e9 na \u00fa\u010dely, na ktor\u00e9 sa z\u00edskavali alebo inak sprac\u00favali;<\/li>\n\n\n\n<li>dotknut\u00e1 osoba odvol\u00e1 s\u00fahlas, na z\u00e1klade ktor\u00e9ho sa sprac\u00favanie vykon\u00e1va, pod\u013ea \u010dl\u00e1nku 6 ods. 1 p\u00edsm. a) alebo \u010dl\u00e1nku 9 ods. 2 p\u00edsm. a) Nariadenia, a ak neexistuje in\u00fd pr\u00e1vny z\u00e1klad pre sprac\u00favanie;<\/li>\n\n\n\n<li>dotknut\u00e1 osoba namieta vo\u010di sprac\u00favaniu pod\u013ea \u010dl\u00e1nku 21 ods. 1 Nariadenia a nepreva\u017euj\u00fa \u017eiadne opr\u00e1vnen\u00e9 d\u00f4vody na sprac\u00favanie alebo dotknut\u00e1 osoba namieta vo\u010di sprac\u00favaniu pod\u013ea \u010dl\u00e1nku 21 ods. 2 Nariadenia;<\/li>\n\n\n\n<li>osobn\u00e9 \u00fadaje sa sprac\u00favali nez\u00e1konne;<\/li>\n\n\n\n<li>osobn\u00e9 \u00fadaje musia by\u0165 vymazan\u00e9, aby sa splnila z\u00e1konn\u00e1 povinnos\u0165 pod\u013ea pr\u00e1va \u00danie alebo pr\u00e1va \u010dlensk\u00e9ho \u0161t\u00e1tu, ktor\u00e9mu prev\u00e1dzkovate\u013e podlieha;<\/li>\n\n\n\n<li>osobn\u00e9 \u00fadaje sa z\u00edskavali v s\u00favislosti s ponukou slu\u017eieb informa\u010dnej spolo\u010dnosti pod\u013ea \u010dl\u00e1nku 8 ods. 1 Nariadenia.<\/li>\n<\/ol>\n\n\n\n<p>Ak prev\u00e1dzkovate\u013e zverejnil osobn\u00e9 \u00fadaje a je povinn\u00fd vymaza\u0165 osobn\u00e9 \u00fadaje, so zrete\u013eom na dostupn\u00fa technol\u00f3giu a n\u00e1klady na vykonanie opatren\u00ed podnikne primeran\u00e9 opatrenia vr\u00e1tane technick\u00fdch opatren\u00ed, aby informoval prev\u00e1dzkovate\u013eov, ktor\u00ed vykon\u00e1vaj\u00fa sprac\u00favanie osobn\u00fdch \u00fadajov, \u017ee dotknut\u00e1 osoba ich \u017eiada, aby vymazali v\u0161etky odkazy na tieto osobn\u00e9 \u00fadaje, ich k\u00f3piu alebo repliky.<\/p>\n\n\n\n<p>Pr\u00e1vo na vymazanie sa neuplat\u0148uje, pokia\u013e je sprac\u00favanie potrebn\u00e9:<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"has-body-font-size wp-block-list\">\n<li>na uplatnenie pr\u00e1va na slobodu prejavu a na inform\u00e1cie;<\/li>\n\n\n\n<li>na splnenie z\u00e1konnej povinnosti, ktor\u00e1 si vy\u017eaduje sprac\u00favanie pod\u013ea pr\u00e1va \u00danie alebo pr\u00e1va \u010dlensk\u00e9ho \u0161t\u00e1tu, ktor\u00e9mu prev\u00e1dzkovate\u013e podlieha, alebo na splnenie \u00falohy realizovanej vo verejnom z\u00e1ujme alebo pri v\u00fdkone verejnej moci zverenej prev\u00e1dzkovate\u013eovi;<\/li>\n\n\n\n<li>z d\u00f4vodov verejn\u00e9ho z\u00e1ujmu v oblasti verejn\u00e9ho zdravia v s\u00falade s \u010dl\u00e1nkom 9 ods. 2 p\u00edsm. h) a i), ako aj \u010dl\u00e1nkom 9 ods. 3 nariadenia;<\/li>\n\n\n\n<li>na \u00fa\u010dely archiv\u00e1cie vo verejnom z\u00e1ujme, na \u00fa\u010dely vedeck\u00e9ho alebo historick\u00e9ho v\u00fdskumu \u010di na \u0161tatistick\u00e9 \u00fa\u010dely pod\u013ea \u010dl\u00e1nku 89 ods. 1 nariadenia, pokia\u013e je pravdepodobn\u00e9, \u017ee pr\u00e1vo uveden\u00e9 vy\u0161\u0161ie znemo\u017en\u00ed alebo z\u00e1va\u017en\u00fdm sp\u00f4sobom s\u0165a\u017e\u00ed dosiahnutie cie\u013eov tak\u00e9hoto sprac\u00favania, alebo<\/li>\n\n\n\n<li>na preukazovanie, uplat\u0148ovanie alebo obhajovanie pr\u00e1vnych n\u00e1rokov<\/li>\n<\/ol>\n\n\n\n<p><strong>Pr\u00e1vo na obmedzenie sprac\u00favania pod\u013ea \u010dl\u00e1nku 18:<br><\/strong>Dotknut\u00e1 osoba m\u00e1 pr\u00e1vo na to, aby prev\u00e1dzkovate\u013e obmedzil sprac\u00favanie, pokia\u013e ide o jeden z t\u00fdchto pr\u00edpadov:<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"has-body-font-size wp-block-list\">\n<li>dotknut\u00e1 osoba napadne spr\u00e1vnos\u0165 osobn\u00fdch \u00fadajov, a to po\u010das obdobia umo\u017e\u0148uj\u00faceho prev\u00e1dzkovate\u013eovi overi\u0165 spr\u00e1vnos\u0165 osobn\u00fdch \u00fadajov;<\/li>\n\n\n\n<li>sprac\u00favanie je protiz\u00e1konn\u00e9 a dotknut\u00e1 osoba namieta proti vymazaniu osobn\u00fdch \u00fadajov a \u017eiada namiesto toho obmedzenie ich pou\u017eitia;<\/li>\n\n\n\n<li>prev\u00e1dzkovate\u013e u\u017e nepotrebuje osobn\u00e9 \u00fadaje na \u00fa\u010dely sprac\u00favania, ale potrebuje ich dotknut\u00e1 osoba na preuk\u00e1zanie, uplat\u0148ovanie alebo obhajovanie pr\u00e1vnych n\u00e1rokov;<\/li>\n\n\n\n<li>dotknut\u00e1 osoba namietala vo\u010di sprac\u00favaniu pod\u013ea \u010dl\u00e1nku 21 ods. 1 nariadenia, a to a\u017e do overenia, \u010di opr\u00e1vnen\u00e9 d\u00f4vody na strane prev\u00e1dzkovate\u013ea preva\u017euj\u00fa nad opr\u00e1vnen\u00fdmi d\u00f4vodmi dotknutej osoby.<\/li>\n<\/ol>\n\n\n\n<p>Ak sa sprac\u00favanie v s\u00falade s vy\u0161\u0161ie obmedzen\u00fdm obmedzilo, tak\u00e9to osobn\u00e9 \u00fadaje sa s v\u00fdnimkou uchov\u00e1vania sprac\u00favaj\u00fa len so s\u00fahlasom dotknutej osoby alebo na preukazovanie, uplat\u0148ovanie alebo obhajovanie pr\u00e1vnych n\u00e1rokov, alebo na ochranu pr\u00e1v inej fyzickej alebo pr\u00e1vnickej osoby, alebo z d\u00f4vodov d\u00f4le\u017eit\u00e9ho verejn\u00e9ho z\u00e1ujmu \u00danie alebo \u010dlensk\u00e9ho \u0161t\u00e1tu.<\/p>\n\n\n\n<p>Dotknut\u00fa osobu, ktor\u00e1 dosiahla obmedzenie sprac\u00favania v s\u00falade s vy\u0161\u0161ie uveden\u00fdm, prev\u00e1dzkovate\u013e informuje pred t\u00fdm, ako bude obmedzenie sprac\u00favania zru\u0161en\u00e9.<\/p>\n\n\n\n<p><strong>Pr\u00e1vo na prenosnos\u0165 \u00fadajov pod\u013ea \u010dl\u00e1nku 20:<br><\/strong>Dotknut\u00e1 osoba m\u00e1 pr\u00e1vo z\u00edska\u0165 osobn\u00e9 \u00fadaje, ktor\u00e9 sa jej t\u00fdkaj\u00fa a ktor\u00e9 poskytla prev\u00e1dzkovate\u013eovi, v \u0161trukt\u00farovanom, be\u017ene pou\u017e\u00edvanom a strojovo \u010ditate\u013enom form\u00e1te a m\u00e1 pr\u00e1vo prenies\u0165 tieto \u00fadaje \u010fal\u0161iemu prev\u00e1dzkovate\u013eovi bez toho, aby jej prev\u00e1dzkovate\u013e, ktor\u00e9mu sa tieto osobn\u00e9 \u00fadaje poskytli, br\u00e1nil, ak: a) sa sprac\u00favanie zaklad\u00e1 na s\u00fahlase pod\u013ea \u010dl\u00e1nku 6 ods. 1 p\u00edsm. a) alebo \u010dl\u00e1nku 9 ods. 2 p\u00edsm. a) nariadenia, alebo na zmluve pod\u013ea \u010dl\u00e1nku 6 ods. 1 p\u00edsm. b) nariadenia, a b) ak sa sprac\u00favanie vykon\u00e1va automatizovan\u00fdmi prostriedkami.<\/p>\n\n\n\n<p>Dotknut\u00e1 osoba m\u00e1 pri uplat\u0148ovan\u00ed svojho pr\u00e1va na prenosnos\u0165 \u00fadajov pr\u00e1vo na prenos osobn\u00fdch \u00fadajov priamo od jedn\u00e9ho prev\u00e1dzkovate\u013ea druh\u00e9mu prev\u00e1dzkovate\u013eovi, pokia\u013e je to technicky mo\u017en\u00e9.<\/p>\n\n\n\n<p>Uplat\u0148ovan\u00edm pr\u00e1va nie je dotknut\u00fd \u010dl\u00e1nok 17 nariadenia Uveden\u00e9 pr\u00e1vo sa nevz\u0165ahuje na sprac\u00favanie nevyhnutn\u00e9 na splnenie \u00falohy realizovanej vo verejnom z\u00e1ujme alebo pri v\u00fdkone verejnej moci zverenej prev\u00e1dzkovate\u013eovi. Pr\u00e1vo na prenosnos\u0165 \u00fadajov nesmie ma\u0165 nepriazniv\u00e9 d\u00f4sledky na pr\u00e1va a slobody in\u00fdch.<\/p>\n\n\n\n<p><strong>Pr\u00e1vo namieta\u0165 proti sprac\u00favaniu vr\u00e1tane namietania proti profilovaniu (ak sa vykon\u00e1va) pod\u013ea \u010dl\u00e1nku 21:<br><\/strong>Dotknut\u00e1 osoba m\u00e1 pr\u00e1vo kedyko\u013evek namieta\u0165 z d\u00f4vodov t\u00fdkaj\u00facich sa jej konkr\u00e9tnej situ\u00e1cie proti sprac\u00favaniu osobn\u00fdch \u00fadajov, ktor\u00e9 sa jej t\u00fdka, ktor\u00e9 je vykon\u00e1van\u00e9 na z\u00e1klade \u010dl\u00e1nku 6 ods. 1 p\u00edsm. e) alebo f) nariadenia vr\u00e1tane namietania proti profilovaniu zalo\u017een\u00e9mu na uveden\u00fdch ustanoveniach. Prev\u00e1dzkovate\u013e nesmie \u010falej sprac\u00fava\u0165 osobn\u00e9 \u00fadaje, pokia\u013e nepreuk\u00e1\u017ee nevyhnutn\u00e9 opr\u00e1vnen\u00e9 d\u00f4vody na sprac\u00favanie, ktor\u00e9 preva\u017euj\u00fa nad z\u00e1ujmami, pr\u00e1vami a slobodami dotknutej osoby, alebo d\u00f4vody na preukazovanie, uplat\u0148ovanie alebo obhajovanie pr\u00e1vnych n\u00e1rokov. Ak sa osobn\u00e9 \u00fadaje sprac\u00favaj\u00fa na \u00fa\u010dely priameho marketingu, dotknut\u00e1 osoba m\u00e1 pr\u00e1vo kedyko\u013evek namieta\u0165 proti sprac\u00favaniu osobn\u00fdch \u00fadajov, ktor\u00e9 sa jej t\u00fdka, na \u00fa\u010dely tak\u00e9hoto marketingu, vr\u00e1tane profilovania v rozsahu, v akom s\u00favis\u00ed s tak\u00fdmto priamym marketingom. Ak dotknut\u00e1 osoba namieta vo\u010di sprac\u00favaniu na \u00fa\u010dely priameho marketingu, osobn\u00e9 \u00fadaje sa u\u017e na tak\u00e9 \u00fa\u010dely nesm\u00fa sprac\u00fava\u0165.<\/p>\n\n\n\n<p>V s\u00favislosti s pou\u017e\u00edvan\u00edm slu\u017eieb informa\u010dnej spolo\u010dnosti a bez oh\u013eadu na smernicu 2002\/58\/ES m\u00f4\u017ee dotknut\u00e1 osoba uplat\u0148ova\u0165 svoje pr\u00e1vo namieta\u0165 automatizovan\u00fdmi prostriedkami s pou\u017eit\u00edm technick\u00fdch \u0161pecifik\u00e1ci\u00ed.
